Privacy Policy

1. Introduction

ServiceTarget provides software to improve knowledge management and service processes. We've developed this Privacy Policy to explain how we collect, use, disclose, and store personal data. It also describes your choices and rights with respect to your Personal Data, including your rights of access and correction of your Personal Data. If you do not agree with this Privacy Policy, you should not use our websites or the Subscription Service.

When Does This Privacy Policy Apply? This Privacy Policy only applies when ServiceTarget handles personal data as a Controller (meaning we control processing). This includes when you:

  • Visit/interact with www.servicetarget.com, www.matrixflows.com , template library, marketplace, social media pages, or other Sites we operate ("Digital Properties")
  • When you interact with us on on different channels, for example, by communicating with us via web form, email or chat
  • Register for/participate in webinars, events, marketing, promotional activities
  • Interact with us in person such as visiting offices
  • Inquire about or engage in commercial transactions with us
  • When you use our products and services

Changes: We may update this Privacy Policy periodically - please check back. If you disagree with any changes, please stop using our Digital Properties. When required by law, we will notify you of Privacy Policy updates by posting on our Site or other appropriate manner.

2. Personal Data Collected and Disclosed

The below describes what personal data we collect about you when you visit our Digital Properties and to whom we disclose personal data. California individuals: This section includes the parties we disclose personal data to for a business or commercial purpose, as defined by California law.

Identifiers, such as your name, email address, phone number, postal address; device identifiers such as advertising IDs and IP address. We may disclose identifiers to:

  • Affiliates, subsidiaries, parent/holding companies, acquired companies
  • Service providers like security and platform vendors
  • Third parties to complete transactions like credit card processors
  • Companies operating Cookies and Tracking Technologies
  • Business partners for joint marketing and sales activities
  • Third parties at your direction such as event sponsors
  • Professional advisors including lawyers, accountants, auditors
  • Entities involved in corporate transactions like mergers, acquisitions, or asset sales

Commercial information, such as purchasing history, preferences and transactional information, such as banking information. We may disclose commercial information to:

Audio, electronic, visual, and other sensory information, such as recordings of your interactions with our sales, service or client success teams (e.g., for quality assurance or training purposes, in accordance with applicable laws); or customer support chat or messaging logs. We may disclose this information information to:

  • Affiliates, subsidiaries, parent/holding companies, acquired companies
  • Service providers like security and platform vendors
  • Entities involved in corporate transactions like mergers, acquisitions, or asset sales

Internet or other electronic network activity information and device information, such as your browsing history, search history, device information, and other information regarding your interactions with us and use of our products, Services, emails, and other Digital Properties. We may disclose this information to:

  • Affiliates, subsidiaries, parent/holding companies, acquired companies
  • Service providers like security and platform vendors
  • Companies operating Cookies and Tracking Technologies
  • Entities involved in corporate transactions like mergers, acquisitions, or asset sales

Geolocation information, such as approximate location based on your IP address, mobile device location, or information you provide to us such as city and state you provide through a webform. You may be able to control collection of this data through the settings of your device. We may disclose geolocation information information to:

  • Affiliates, subsidiaries, parent/holding companies, acquired companies
  • Service providers like security and platform vendors
  • Companies operating Cookies and Tracking Technologies
  • Entities involved in corporate transactions like mergers, acquisitions, or asset sales

Sensitive Personal Data, such as proof of vaccination or race and ethnicity (optional) (where permissible under applicable law). We may disclose this information to:

  • Affiliates, subsidiaries, parent/holding companies, acquired companies
  • Service providers like security and platform vendors
  • Entities involved in corporate transactions like mergers, acquisitions, or asset sales
  • Any party with your consent

In addition to the above disclosures, we may share your personal data to respond to lawful requests by law enforcement or other government authorities, including to meet national security requirements, in accordance with our Government Data Request Policy. We may also de-identify, anonymize, or aggregate personal data to use or share with third parties for any purpose, where legally permitted.

3. How We Process Personal Data

We may process your personal data for the below purposes:

  • To provide, maintain, and improve our products, services, and digital properties to you, including processing transactions, enabling access, communicating with you about support and updates, and diagnosing and fixing issues. Legal Basis: Legitimate Interests, Contract, Legal Obligations.
  • For our own business purposes, including internal business operations like record-keeping, accounting, IT management, security, research, and development. Legal Basis: Legitimate Interests, Legal Obligations.
  • For legal, safety, and security reasons, including complying with laws, establishing legal claims, protecting safety and rights, investigating violations, and detecting fraudulent activities.

  • To market our and third party products and services, such as sending promotional communications, facilitating contests, and customizing ads. Legal Basis: Consent (where required), Legitimate Interests. You may opt out of marketing communications at any time. Note that some of our marketing materials and information may use tracking technologies and analytics tools to help us understand your preferences. For further information, please see Section 5 below and our Cookie Policy.
  • To fulfill a referral request when you refer others to our Service, including by using the name, email address, title, and company name that you provide us to contact the person you are referring to. You must only provide others’ personal data if you have their consent to do so. Legal Basis: Consent (where required), Legitimate Interests

ServiceTarget will honor individual data rights as required by law. You may have the right to access, correct, update, and in some cases request deletion of your personal data (subject to exceptions). You can submit data rights requests through our contact us page.

ServiceTarget uses a limited number of third-party service providers to help process data for certain purposes like supporting site features, database monitoring, data transmission, and data storage. These third parties may process or store personal data while providing services.

4. Sources of Personal Data

  • Information you provide directly - when registering, communicating through our Digital Properties, visiting offices, participating in events/marketing/outreach
  • Information from employer/coworkers/friends - info about reps/employees of current/past/prospective customers, suppliers, investors, partners. May receive referrals.
  • Automatically collected information - technical info about interacting with our Digital Properties like IP address, browsing preferences, purchase history. More in Section 5 and Cookie Policy.
  • Public information - public records, info you share publicly like social media.
  • Other third parties - info from third-party service/content providers, partners to sell/promote products/services, social media networks and related widgets.

We may combine info from these sources, including third-party and public, and use/disclose it for the identified purposes.

5. Cookies and Tracking Technologies

We use cookies and tracking technologies, offer settings management as described in our Cookie Policy. Some technologies track device activity over time/sites/devices. We do not honor Do Not Track signals from browsers currently.

6. Security and Retention

We maintain appropriate security measures and procedures to protect your personal data against accidental or unlawful destruction, loss, disclosure, alteration, or use.

Your personal data is generally retained as long as needed to fulfill the purposes collected. Once you/your company ends the relationship with us, we may retain data to ensure contract fulfillment, other legitimate business purposes like evidencing practices/obligations, providing product/service info, or complying with legal/tax/accounting requirements. When we have no ongoing business need or lawful grounds to process your data, we will delete, anonymize, or aggregate it or, if not possible (like backup archives), securely store and isolate it from processing until deletion is possible. 

7. Children's Privacy

Our Sites and Services are not directed to children under 16, and we do not knowingly collect their personal data online. If you are a parent/guardian and believe your child disclosed data to us, please contact us per Section 9.

8. External Links

When interacting with us, you may encounter links to external sites or services, including in third-party ads. We do not control and are not responsible for the privacy or data policies of such third-party sites/services. Consult them and their privacy policies if you have questions about their practices.

10. Supplemental Terms for California Residents

Under the California Consumer Privacy Act (CCPA), this Section 10 supplements the Privacy Policy for certain personal data of California residents where ServiceTarget controls processing (a "business") and does not apply to current/former employees, applicants, contractors, Users.

The below shows categories of personal data we have sold, shared, or disclosed to third parties as defined by the California Privacy Rights Act. Section 2 provides categories collected and disclosures.

While we have not sold or shared personal data for money in the past 12 months, our digital properties involve routine practices with third parties that could be considered a "sale" or "sharing" under California law. We do not knowingly sell or share personal data of minors under 16. We only collect or process "sensitive personal information" as permitted by exceptions, and do not use it to infer characteristics about you.

Financial Incentives: We may offer benefits like discounts or coupons for participating in surveys where we collect personal information like your name, contact details, preferences, and opinions. Participation is subject to applicable terms describing the incentives and how to participate. Incentive values are calculated based on associated expenses. You can withdraw from any incentive program by emailing legal@servicetarget.com. If we offer another type of incentive, we will provide the material terms when asking you to participate.

Your Data Protection Rights: Subject to legal limitations, CA residents may have rights to:

  • Right to Know - Request info on categories of personal data collected, sources, purposes, third-party disclosures. Can also request specific pieces collected.
  • Right to Delete - Request we delete collected personal data.
  • Right to Correct - Request we correct inaccurate personal data.
  • Right to Opt Out - We explain in Section 5 that we share with advertising partners who collect info from our Digital Properties. This may be considered a "sale" or "sharing" under CA law and you can opt out.

California residents may request to exercise the Right to Know, the Right to Delete, and the Right to Correct by using our webform or by emailing us at legal@servicetarget.com. We will not discriminate for exercising these rights.

How to Fully Opt Out of Sale/Sharing: To fully opt out of any sale/sharing:

  1. Submit opt out request by webform
  2. Disable advertising cookies/tracking by clicking the "Do Not Sell or Share" link in website footer on each site, browser, and device. This places an opt out cookie.

If you block cookies, we cannot comply with opt out requests for data collected by cookies/pixels/tracking. If you clear cookies, redo Step 2. We will honor "Do Not Sell or Share" browser signals.

Verification: To process CA requests, we may obtain info to verify identity depending on the request. We may request info like name, email, or other identifiers. For a Specific Pieces Report, we may request a declaration under penalty of perjury. We may request alternative verification and use third parties to help verify identity.

Authorized Agents: Users can submit CA requests for individuals, but we may verify identity directly. Users must use webform and indicate they are a User. We may require demonstration of authority to act on your behalf. We may also require you to verify identity directly or confirm User permission.

Timing: We process opt out requests within 15 business days. We respond to Requests to Delete and Requests to Know within 45 days, up to 90 days if more time needed and we will notify you.

11. Supplemental Info for EEA, Switzerland, and UK

The following terms supplement the Privacy Policy for processing of EEA, Swiss, and UK personal data. In any conflict between Section 11 and other sections, Section 11 governs for EEA, Swiss, and UK data.

Your Data Protection Rights

Under data protection laws, you may exercise rights regarding your personal data:

  • Right to Access - Obtain confirmation if we process your data and a copy of the data.
  • Right to Data Portability - Receive your provided data in a structured, commonly used, machine readable format, and transmit it to other controllers. Applies if processing is based on consent or contract and done by automated means.
  • Right to Rectification - Request correction of inaccurate data and completion of incomplete data.
  • Right to Object - Object to processing of your data in certain cases.
  • Right to Restrict Processing - Request we restrict processing in certain cases.
  • Right to Erasure - Request erasure of your data in certain cases.
  • Right to Lodge Complaint - Lodge complaint with supervisory authority. We commit to cooperate and comply with EU, UK ICO/GRA, and Swiss FDPIC advice on unresolved complaints about handling of data under EU-US DPF, UK Extension, and Swiss-US DPF.
  • Right to Refuse/Withdraw Consent - Refuse or withdraw consent at any time if asked for consent to process your data. Withdrawal does not affect prior lawful processing based on consent given.
  • Right to Not Be Subject to Automated Decision-Making - We do not engage in automated decision making referred to in EU/UK GDPR Article 22(1) and (4). If this changes, we will inform you and you have rights to human intervention, express view, and contest decisions.

Exercise rights by contacting us per Section 9. We may refuse requests to exercise rights in some cases like infringing others' privacy or our obligations.
