These ServiceTarget AI Supplementary Terms are part of the Terms of Service between you and ServiceTarget PBC. They apply when you access or use any ServiceTarget AI features. Terms used here have the same definitions as in the main Terms of Service.
“ServiceTarget AI” are services that include features, applications, bots, and other functionalities based on artificial intelligence and machine learning data models
“ServiceTarget AI Assistant” refers to a suite of AI-powered writing and content creation tools offered by ServiceTarget. This includes generative capabilities for authoring and editing content, drafting new content from prompts, editing tools for refining existing text, extractive summarization to pull key information from documents, and translation features across languages.
Currently ServiceTarget AI is offered as a Pre-Released Beta Service. These ServiceTarget AI Supplemental Terms and Master Service Agreement incorporated herein by reference, cover accessing and using ServiceTarget AI by your Users and End-Users.
To ensure optimal performance for all customers, ServiceTarget AI has fair usage restrictions based on your subscription plan, as documented here. By agreeing to the terms of service, you acknowledge that exceeding the usage limits of your ServiceTarget AI plan may result in:
Your Users and End-Users may provide or make available input to ServiceTarget AI, which may include text, prompt or any other content (“Input”) and receive responses generated by ServiceTarget AI which may include content, suggestions, formula or any other output (“Output”). When you use ServiceTarget AI, Input and Output are your Service Data. You are solely responsible for the development, content, operation, maintenance, and use of your Service Data. You acknowledge that due to the nature of machine learning, other Subscribers, Users, and End-Users may use ServiceTarget AI in a manner which may generate identical or similar Output. We make no representations or warranties with regards to Output, including of ownership thereof.
You agree to use ServiceTarget AI responsibly. Your use of ServiceTarget AI, including any Input provided or Output generated, must comply with all applicable laws, ServiceTarget's Terms of Service, and third party rights including intellectual property and privacy rights. You are solely responsible for how you use ServiceTarget AI and any content created through it.
ServiceTarget may collect and use data about your interaction with or use of ServiceTarget AI, including Input and Output, to improve and develop ServiceTarget AI and to provide you with ServiceTarget AI functionality.
ServiceTarget does not use your specific Input/Output to train the machine learning models used to provide the ServiceTarget AI.
You may not use ServiceTarget AI or its Output to: (i) Develop competing foundation or large scale models; (ii) Mislead that Output was solely human-generated; (iii) Generate spam or campaign content; (iv) Violate any technical docs, usage guidelines, or parameters.
You acknowledge and agree that your use of the ServiceTarget AI is in accordance with our Acceptable Use Policy.
SERVICETARGET DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS REGARDING SERVICETARGET AI, ITS FEATURES, FUNCTIONALITIES, OUTPUTS AND/OR THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF SERVICETARGET AI AND/OR THE OUTPUT. USE OF SERVICETARGET AI AND/OR OUTPUT IS MADE AT YOUR OWN RISK. SERVICETARGET AI IS PROVIDED “AS IS”, “WITH ALL FAULTS” AND ״AS AVAILABLE״, WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED AND SERVICETARGET.COM EXPRESSLY DISCLAIMS ALL SUCH WARRANTIES OR REPRESENTATIONS, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OR REPRESENTATIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUALITY, COMPLETENESS, NON-INFRINGEMENT, RELIABILITY, AVAILABILITY AND PERFORMANCE. SERVICETARGET.COM DO NOT WARRANT OR REPRESENT THAT SERVICETARGET AI AND/OR OUTPUT WILL BE UNINTERRUPTED, ERROR OR BUG FREE, NON-OFFENSIVE, NON-INFRINGING, NON-HARMFUL ACCURATE, LAWFUL OR APPROPRIATE.
NOTWITHSTANDING ANYTHING IN THESE SUPPLEMENTARY AI TERMS OR ELSEWHERE TO THE CONTRARY AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: IN NO EVENT SHALL SERVICETARGET, ITS AFFILIATES AND THIRD-PARTY PROVIDERS BE LIABLE FOR: (I) ANY INDIRECT, EXEMPLARY, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES; (II) ANY LOSS OF PROFITS, COSTS, BUSINESS, OR ANTICIPATED SAVINGS; (III) ANY LOSS OF, OR DAMAGE TO DATA, INTELLECTUAL PROPERTY, REPUTATION, REVENUE OR GOODWILL; (IV) THE FAILURE OF SECURITY MEASURES AND PROTECTIONS; AND/OR (V) THE COST OF PROCURING ANY SUBSTITUTE GOODS OR SERVICES. THE FOREGOING EXCLUSIONS AND LIMITATIONS ON LIABILITY SET FORTH IN THESE SERVICETARGET AI TERMS SHALL APPLY: (I) EVEN IF SERVICETARGET, ITS AFFILIATES OR THIRD-PARTY PROVIDERS, HAVE BEEN ADVISED, OR SHOULD HAVE BEEN AWARE, OF THE POSSIBILITY OF LOSSES OR DAMAGES; (II) EVEN IF ANY REMEDY IN THESE TERMS FAILS OF ITS ESSENTIAL PURPOSE; AND (III) REGARDLESS OF THE THEORY OR BASIS OF LIABILITY (SUCH AS, BUT NOT LIMITED TO, BREACH OF CONTRACT OR TORT). IN ANY EVENT, SERVICETARGET’S TOTAL AGGREGATE LIABILITY FOR ALL DAMAGES AND LOSSES UNDER THESE SERVICETARGET AI TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS.
Anything to the contrary in the Terms of Service, any downtime of ServiceTarget AI resulting from failure of a third party service will not be counted towards Availability and Downtime calculations.
If you choose to use the ServiceTarget AI feature(s), you may not use the ServiceTarget AI features in a manner that violates any OpenAI Policy, including their Content Policy; Sharing and Publication Policy; and Community Guidelines.
